The platform provides a technology platform that facilitates communication between users for property-related purposes. It is not a real estate broker, property dealer, legal advisor, financial advisor, or representative of any party involved in a property transaction.
By accessing or using the platform, you confirm that you have the legal authority and capacity to use the Services and agree to comply with these Terms and all applicable laws.
Your use of the Services also signifies your acceptance of the Privacy Policy and any additional policies or guidelines published by us from time to time.
If you use the Services on behalf of another individual, business, or organization, you represent that you have the authority to bind that individual or entity to these Terms.
We reserve the right to revise, modify, or replace these Terms at any time. Updated Terms become effective once published through the application or website. Continued use of the Services after such publication constitutes acceptance of the revised Terms.
The Services are available to users who have the legal capacity to use the platform and agree to comply with these Terms and all applicable laws of India.

Certain features of the platform require users to create an account using a valid mobile number and complete verification through One-Time Password (OTP).
During registration, users may be required to provide information such as their name, email address, district, and taluka. Users are responsible for ensuring that all information provided remains accurate, complete, and up to date.
Users are responsible for maintaining the confidentiality of their account and OTP verification. Any activity carried out through a user's account will be considered the responsibility of that user unless unauthorized access is proven.
We reserve the right to verify user information, request additional details where necessary, and restrict, suspend, or terminate accounts that contain false information or violate these Terms.
Users agree to use the platform responsibly, honestly, and only for lawful purposes.
Users are solely responsible for ensuring that all profile information, property details, descriptions, pricing information, photographs, ownership information, location details, and other content submitted through the platform are accurate, genuine, complete, and legally permitted to be published.
Users must not submit false, misleading, fraudulent, unauthorized, defamatory, illegal, or inappropriate information through the platform.
Users are responsible for ensuring that they possess all necessary rights and permissions relating to any property information, photographs, documents, or other content submitted through the platform.
Users acknowledge that we only provide a technology platform and do not participate in negotiations, agreements, or transactions between users.
Users may publish property listings by providing the information requested within the application.
Each listing must contain genuine, accurate, and lawful information.
Users must not publish property listings that include false ownership claims, misleading descriptions, incorrect property locations, manipulated information, duplicate listings, unauthorized photographs, copyrighted material without permission, illegal property information, offensive content, spam, or any material that violates applicable laws or these Terms.
Users should promptly update or remove property listings whenever the information becomes inaccurate, unavailable, or no longer reflects the actual status of the property.
We reserve the right to review, edit, restrict, suspend, reject, remove, or permanently delete any listing that violates these Terms or the policies governing the platform.
We follow a review-based publishing process to maintain the quality, reliability, and authenticity of property listings available on the platform.
Whenever a user submits a property listing, it is reviewed by the administration team before it becomes publicly visible. During the review process, we may verify the submitted information, contact the listed contact person, request additional information where necessary, and determine whether the listing complies with the platform's policies and quality standards.
We reserve the right, at our sole discretion, to approve, reject, edit, suspend, hide, or permanently remove any property listing that contains inaccurate information, fake details, misleading content, duplicate listings, unauthorized photographs, false ownership claims, illegal content, or any material that violates these Terms or applicable laws.
Approval of a property listing does not constitute verification of ownership, legal status, documentation, market value, condition, availability, or authenticity of the property. Users are solely responsible for independently verifying all property-related information before entering into any transaction.
To maintain a safe, reliable, and trustworthy platform, we reserve the right to monitor and manage all activities carried out through the Services.
Our administrators may review, approve, reject, edit, hide, suspend, restore, or permanently remove property listings, user-generated content, subscriptions, or user accounts whenever considered necessary for platform management or policy enforcement.
We may also request additional information, verify submitted details, contact users for clarification, investigate suspicious activities, and take appropriate action where platform misuse or policy violations are identified.
We are committed to protecting users from fraudulent, misleading, and abusive activities.
Without prior notice, we may temporarily suspend or permanently terminate a user account if we reasonably believe that the user has submitted fake property information, false ownership claims, duplicate listings, misleading descriptions, unauthorized photographs, manipulated location details, impersonated another person, repeatedly violated platform policies, attempted to misuse platform features, engaged in fraudulent or unlawful activities, or otherwise breached these Terms.
Where appropriate, we may also remove associated property listings, restrict future registrations, or deny continued access to the Services.
If an account is suspended or permanently terminated due to violations of these Terms, the user may lose access to associated account features and any active benefits available through the account.
The application may offer one or more subscription options that provide access to additional features and services.
The features, pricing, billing frequency, renewal terms, validity, and other applicable details of each subscription are displayed within the application before a purchase is completed and may be updated from time to time.
Some subscriptions automatically renew unless cancelled before the applicable renewal date. Information regarding automatic renewal is displayed within the application before purchase.
Purchasing a subscription provides access only to the features included with that subscription. It does not guarantee approval of any property listing, property sale, rental, inquiries, customer responses, leads, or successful transactions.
The platform reserves the right to introduce new subscription options, modify available features, update subscription details, or discontinue any subscription offering in accordance with applicable laws.
Users may purchase more than one subscription where such subscriptions are made available within the application.
Each subscription is managed independently and remains active according to its applicable subscription period unless cancelled by the user or otherwise terminated in accordance with these Terms.
Where multiple subscriptions are active simultaneously, the features and benefits associated with each subscription will continue to be available in accordance with the respective subscription purchased.
Certain subscriptions offered through the application automatically renew at the end of each subscription period unless cancelled before the applicable renewal date.
Users may manage or cancel their subscriptions at any time through the account settings of the device used to make the purchase.
Cancelling a subscription prevents future renewals only. The current subscription remains active until the end of the applicable subscription period, after which access to subscription features will end unless renewed.
Except where required by applicable law, subscription purchases are non-refundable. No full refund, partial refund, credit for unused time, or transfer of subscription benefits will be provided after a subscription has been activated.
Deleting an account, uninstalling the application, changing a mobile number, or choosing not to use subscription features does not automatically cancel an active subscription or create any entitlement to a refund.
If a subscription or account is suspended or terminated due to fraud, misuse of the platform, fake listings, policy violations, or other violations of these Terms, no refund or compensation will be provided.
Access to subscription features is provided after successful purchase confirmation within the application.
By purchasing a subscription, users authorize recurring billing according to the subscription selected within the application until the subscription is cancelled.
Users are responsible for reviewing the subscription details displayed within the application before completing a purchase.
If a purchase cannot be completed due to technical reasons, subscription access may not become available until the purchase is successfully processed.
The platform reserves the right to correct technical errors, subscription activation issues, or pricing display errors where reasonably necessary and in accordance with applicable laws.
The visibility of property listings, contact details, and certain account information may vary depending on the features available within the application and the subscription associated with a user's account.
Certain contact information related to a property listing may be displayed only where such visibility is supported by the applicable features of the platform.
The availability of property listings, contact details, and other features does not guarantee inquiries, responses, property sales, rentals, negotiations, or successful transactions.
Users retain ownership of the photographs, descriptions, property information, and other content they upload through the platform.
By submitting content, users grant the platform a non-exclusive, worldwide, royalty-free license to use, store, reproduce, display, modify (only where reasonably necessary for formatting or platform operation), and process such content solely for the purpose of operating, improving, maintaining, promoting, and providing the Services.
Users represent and warrant that they own or have all necessary rights, permissions, and authority to upload any content submitted through the platform and that such content does not infringe the intellectual property, privacy, or other legal rights of any third party.
The platform reserves the right to remove, restrict, edit, or disable access to any content that violates these Terms, applicable laws, or the rights of any person.
All rights relating to the Binkheti name, logo, branding, application, software, design, graphics, source code, text, features, and other proprietary materials remain the exclusive property of Binkheti or its licensors and are protected by applicable intellectual property laws.
Users shall not copy, reproduce, distribute, modify, reverse engineer, license, sell, or commercially exploit any part of the Services without prior written permission.
The Services provide a platform that enables users to connect for property-related purposes.
All discussions, negotiations, inspections, document verification, agreements, payments, purchases, rentals, and other transactions are conducted solely between the concerned parties.
Users are solely responsible for verifying property ownership, legal documents, approvals, permissions, pricing, availability, location details, and any other information before entering into any transaction.
The platform does not participate in, supervise, control, or guarantee any transaction, agreement, or communication between users and shall not be responsible for disputes, losses, damages, fraud, misrepresentation, or failed transactions.
The Services are provided on an "as available" and "as is" basis.
Although property listings may be reviewed before publication, such review is performed only for platform management purposes and should not be interpreted as legal verification, ownership verification, document verification, certification, endorsement, or a guarantee regarding any property.
No representation or warranty is made regarding the accuracy, completeness, reliability, legality, availability, suitability, or authenticity of any property listing or user-submitted information.
Users are encouraged to independently verify all information and seek appropriate professional advice before making any property-related decision.
To the fullest extent permitted by applicable law, neither Binkheti nor its owners, employees, affiliates, licensors, service providers, or representatives shall be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of, or inability to use, the Services.
This limitation includes, without limitation, losses arising from property listings, user-generated content, inaccurate information, technical failures, interruptions, account suspension, communication between users, transactions, loss of data, loss of business opportunities, or any act or omission of another user.
Users acknowledge that they use the Services entirely at their own discretion and risk.
Users agree to defend, indemnify, and hold harmless Binkheti, its owners, employees, affiliates, licensors, representatives, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or relating to the user's violation of these Terms, misuse of the Services, user-generated content, infringement of third-party rights, fraudulent activities, or violation of applicable laws.
Every reasonable effort is made to keep the Services available and operating efficiently. However, uninterrupted or error-free operation cannot be guaranteed.
Temporary interruptions may occur due to maintenance, software updates, server maintenance, internet failures, security incidents, technical issues, or circumstances beyond reasonable control.
The Services, features, subscription options, or any part of the platform may be modified, updated, restricted, suspended, or discontinued at any time where reasonably necessary.
These Terms and Conditions may be updated, modified, or replaced from time to time to reflect changes in legal requirements, technology, business operations, or the Services.
Any revised version becomes effective once published through the application or website, unless otherwise required by applicable law.
Continued use of the Services after such changes constitutes acceptance of the updated Terms.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Rajkot, Gujarat, India, unless otherwise required by applicable law.
